1 Who we are

These Terms of Use ("Terms") govern your access to and use of the mobile application "LVLUP Swiss" (the "App"). The provider of the App is LVLUP Swiss (sole proprietorship / Einzelunternehmung; not yet registered in the commercial register) ("we", "us", "Provider").

2 Acceptance of these Terms

By downloading, installing, accessing or using the App, you agree to these Terms. If you do not agree, do not use the App.

3 The App and eligibility

The App is a Swiss German learning application providing learning content, exercises and audio playback. It is intended for private learning use. You must comply with applicable laws and the store rules (Apple / Google).

4 Accounts

To use certain features you may need an account. Account data may include:

• Name
• Email address
• Password
• An optional profile image

You are responsible for keeping your login details confidential and for all activity that occurs under your account.

5 Subscriptions and payments (Freemium)

The App may offer optional paid subscriptions to unlock premium features. Billing, renewals, cancellations and refunds are handled exclusively by the Apple App Store or Google Play and are subject to their respective policies.

• Price: Displayed in the App Store / Google Play at time of purchase.
• Free trial: 14 days (if offered in the store listing at the time of subscription).
• Cancellation: At any time via your App Store / Google Play account settings, effective at the end of the current billing period.

6 Intellectual property

The App and all associated content — including text, audio, UI elements, logos and software — are protected by intellectual property laws and belong to the Provider or its licensors.

You receive a limited, personal, non-transferable, revocable licence to use the App solely for your private learning purposes.

7 Prohibited use

The following actions are strictly prohibited:

• Sharing accounts or access credentials with others.
• Reverse engineering, scraping, harvesting data, or attempting to bypass security measures.
• Interfering with the App's operation (e.g., attacks on availability, integrity or security).
• Using the App in a way that violates third-party rights or applicable law.

8 Availability, changes and updates

We aim to keep the App available, but we cannot guarantee uninterrupted or error-free operation. We may update, change, suspend or discontinue parts of the App at any time, including features in the free or paid tiers.

9 Disclaimer of warranties

The App is provided "as is" and "as available". To the maximum extent permitted by Swiss law, we disclaim all warranties, including fitness for a particular purpose and non-infringement.

10 Limitation of liability

To the maximum extent permitted by Swiss law, we are not liable for indirect or consequential damages, loss of profit, loss of data, or damages arising from interruptions or errors.

Nothing in these Terms limits liability for intent or gross negligence where such limitation is not permitted by mandatory law.

11 Termination and account deletion

You may stop using the App at any time. You can request account deletion via the in-app function "Delete account" where available.

Account deletion is intended as a hard delete. Some limited technical logs may be retained for security and legal compliance purposes for a limited period.

13 Governing law and jurisdiction

These Terms are governed by Swiss law. The exclusive place of jurisdiction is Zurich, Switzerland.

14 Changes to these Terms

We may update these Terms from time to time. If changes are material, we will make reasonable efforts to inform you within the App. Continued use of the App after the effective date of any update constitutes acceptance of the revised Terms.
